License Agreement

This License Agreement is by and between the Diener Education Fund (“DEF”) and you as a “User” of the Noba Site. This License Agreement supplements the terms of the Noba Terms of Service and Privacy Policy, all of which are effective as of the date the User accepts the license as provided below.

  1. 1. Grant of Limited License

    DEF is the owner or licensee of copyrighted material distributed through the Noba Site (the “Authored Work”). In accordance with this Agreement, and as supplemented by the Terms of Service, by clicking “Sign Up” to become a registered user of the Noba Site, DEF grants User a Creative Commons Attribution-NonCommercial-Share Alike 4.0 International License.

  2. 2. Payment Terms

    User may use the Authored Work free of charge but only as provided herein, and only during any period in which the User is not in violation of the License Agreement or the Noba Terms of Service.

  3. 3. Modifications

    User may modify or change the Authored Work in any manner consistent with the Creative Commons license to meet the user’s needs but may not modify or change the original Authored Work in any manner on the NOBA website itself. The derivative work may be posted on the NOBA website with the prior permission of a duly authorized representative of DEF.

  4. 4. Breach

    In the event of breach of this License Agreement or any of the Noba Terms of Service DEF in its sole discretion shall have the option to revoke this license and User’s access to the Noba Site immediately and without warning and to exclude the User from further use of or access to the Noba Site.

  5. 5. Removal or Modifications to Content

    From time to time and at the sole discretion of DEF the Authored Work and any other materials found on the Noba site (collectively the “Content”) may be changed, deleted or otherwise modified without prior notice to Users.

  6. 6. Warranties

    User accepts the product “as is” and subject to the warranty and liability limitations as provided in the Terms of Use.

  7. 7. Amendment

    This Agreement may be amended by DEF by notice on the Noba Site at any time. Acceptance of this Agreement as well as of the Noba Terms of Service and the Privacy Policy are required before using the Noba Site or accessing the Content.

  8. 8. Supplemental Terms

    All other terms are as provided in the Noba Terms of Service, into which this Agreement is incorporated by reference.

  9. 9. Agreement

    By Clicking “Sign up” you, the “User” represent and warrant that you have read this License Agreement, the Noba Terms of Service and the Noba Privacy Policy, and that you accept and agree to all of the terms of each of those documents, and agree to defend, indemnify and hold harmless DEF and its contractors from any breach of the representations made in this Section 9.
